Make your visit with us a relaxing and enjoyable time by knowing as much as possible about our vacation rentals.

Please read these terms and conditions.

Renter must be at least 21 years old to place a reservation and check-in.

 

Deposits and Payments: 
A deposit, equal to 25% of the rental rate, the booking fee and the security deposit are due and payable to Manasota Key Realty at the time of booking your reservation.  A credit card (Visa or MasterCard) is required for this initial deposit.  Final payment is due 60 days prior to your check-in date and may be made by personal check, Visa or MasterCard. Damage: 
Renter agrees to pay a security deposit between $300-$1000, which shall be in the form of a Visa or MasterCard authorization. The security/damage deposit is collected as part of the initial payment or with full balance due. Security Deposits are returned in the form of a check and mailed to the address provided on the reservation provided there is no damage or additional charges.  In the event of damage to the premises, its equipment, furniture, or carpeting, or violation of any rules, Renter hereby authorizes Conch Out Vacations at Manasota Key Realty to charge the credit card for the cost of any repairs, replacements, services, or excessive cleaning, for all damage, breakage and/or loss incurred during his/her stay, based on the Agent’s sole discretion.  Renter shall be responsible for damage costs exceeding the security deposit, including collection costs and attorney’s fees.  Documentation detailing damages and charges will be provided to the Renter, should this be needed.

 

Home and Condo Equipment: 
All homes and condos are privately owned and equipped for turnkey vacations.  Bed linens are provided as well as bath linens.  Maintenance problems in the home or condo will be handled in a timely and professional manner.  The rental rate will not be adjusted due to any malfunction of equipment, which includes, but is not limited to TV’s, air conditioner units, hot water heaters, stoves, refrigerators, door locks, etc.

 

Utilities: 
In the case of excessive use of utilities, charges will be taken from your security deposit based on the Agent’s sole discretion.

 

Maximum Occupancy/Gatherings: Our properties are located in residential areas and are rented for personal vacation use only.  Each property has a specific maximum occupancy.  Take note of the maximum number of guests allowed in the homes and condos before making your reservation.  Under no circumstances may more than the maximum number of guests, advertised by Conch Out Vacations at Manasota Key Realty, occupy the property unless you have received a written agreement from Conch Out Vacations at Manasota Key Realty prior to your arrival.  Parties and other large gatherings are not allowed.  Prior arrangements for weddings, family reunions, etc. may be made through Conch Out Vacations at Manasota Key Realty.   Those that break maximum occupancy of the home or have a large gathering risk forfeiture of their security deposit, rental fees, and eviction.  

 

No Smoking: 
All homes and condos are NON-SMOKING! No exceptions or forfeiture of your Security/Damage Deposit. 

Pet Policy: 
All pets are subject to approval.  The pet free is $150 per pet (unless otherwise specified), which is taxable and non-refundable.  The limit is no more than 2 pets.  Cats are not allowed (unless otherwise specified).  Approval for pets in all properties must be previously arranged with an agent, of Conch Out Vacations at Manasota Key Realty.  If a pet or animal is found inside the accommodation that has not been previously approved, you will be deemed as breaching the terms and conditions of the rental agreement and will forfeit the security deposit.  All pets must be leashed at all times while outside.  Please be courteous and pick up after your pet while on the property grounds and within the community.  Any excessive cleaning by housekeeping as a result of your pet will result in additional cleaning fees and be taken from your security deposit.

Additional Provisions: 
The Agent may enter the premises at any time in the event of an emergency, but will use their best efforts to give 24-hour notice for normal maintenance or sales inspections or sales showings.

 

On occasion, it may be necessary to change the accommodation you have selected, and we reserve the right to substitute a comparable accommodation without notice or liability. Where such changes are considered a significant alteration, we undertake to advise you as soon as is reasonably possible.  Where a major change is a change to a lower standard of accommodation or reduced facilities and provided it does not arise from circumstances or events beyond our control. You will have the choice of either accepting the alternative arrangements and charges or once instructions have been received in writing from you, you will receive a refund of all monies paid.

 

Refunds do not apply where performance of our contract with you is prevented by risk of war or threat of war, civil strife, industrial dispute, terrorists’ activity, natural and nuclear disaster, adverse weather conditions, Red Tide, pandemic, technical problems with ground transportation, closure or congestion of airports or ports, cancellations, or changes of schedule by airlines, and similar events beyond our control. In the unlikely event that, through circumstances outside of our direct control we are unable to offer you alternative accommodation in accordance with the above paragraphs, we reserve the right to cancel your accommodation. If this occurs, we will inform you as soon as possible and refund all monies paid, provided the cancellation does not arise from the reasons stated in the above paragraph.

 

Fees: 
A non-refundable booking fee will be added to each reservation per each property’s description. A fee of $35.00 will be charged for all returned checks.  A non-refundable $150 pet fee will be collected per pet (see Pet Policies). A $100 fee will be charged for any cancellations for any reason at any time and will be deducted from your rental deposit (see Cancellation and Refunds Policies).

 

Cancellation and Refunds Policies: 
The amount refunded is based on the date Conch Out Vacations at Manasota Key Realty receives written confirmation. Any reservation cancelled more than 60 days prior to your arrival date will receive the initial deposits refunded minus the property’s booking fee and the $100 cancellation fee.  Any cancelled reservations made any time after full payment is made (which is 60 days prior to your arrival date) you forfeit your entire rental payments.  If you wish to cancel your reservation, the person who signed the guest registration form must do so by sending written confirmation (by email, fax, or mail).  Cancellations made under the Cancellation and Refunds Policies will have the refund check processed after we receive written cancellation notice and are sent via check to the home address on the reservation. 

COVID Policy:

Since we have no control over what other states mandate, our cancellation/refund policy as applied, regarding the Covid virus will be based solely on the state of Florida mandates regarding the Covid virus. Travel restriction mandates by states other than the state of Florida will not be a basis for cancellations or refunds. In the event that Florida’s governor bans vacation rentals or bans guests traveling to Florida from certain states who have a confirmed reservation, Conch-Out Vacations at Manasota Key Realty will allow you to reschedule your vacation rental for another time period, based on availability, or you may cancel your reservation. Cancellations made under the Covid Policy will have the refund check processed in the amount of what has been paid minus the booking fee.

 

Rates:

We will do our best to ensure that the rental price of your accommodation will not be subject to any surcharge once you have paid the initial deposit and received signed paperwork. However, we reserve the right to increase or decrease our published prices at any time. Currently, rental rates are subject to 12% sales tax in Charlotte and Sarasota Counties. If the State and/or County alter the tax rate, we may need to amend your booking amount accordingly.

 

Disclaimer:

Manasota Key Realty, Inc. and its employees are not responsible for errors. Details, inventory and features of the property are subject to change. The Renter agrees that Conch Out Vacations at Manasota Key Realty shall not be liable to Renter, Renter’s guests, invitees or any other person for any injury, loss or damage to any person or property on or about the rental premises. Renter shall hold Conch Out Vacations at Manasota Key Realty harmless and indemnified from and against all loss or damage occasioned by use, misuse or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect, or default of the Renter, his/her guests or invitees. The Renter acknowledges that Conch Out Vacations at Manasota Key Realty acting solely in the capacity of Agent for the property owner, assumes no liability thereunder.

 

Agency:

Manasota Key Realty, Inc. is the Agent for the Owner of this Unit, and reserves the right to refuse services to anyone for any reason, to cancel a reservation and/or relocate a guest to another unit. The Owner also reserves the right to place this unit for sale. The Renter hereby agrees to save and hold harmless the Owner of the property and the Agency from all costs due to injury or damage to any person or property whatsoever, any of which is caused by an activity, condition or event arising out of the use of the rental property or for loss of money, jewelry or valuables of any kind.

 

Our Responsibility for your Accommodation:

A private individual over whom Manasota Key Realty, Inc. has no direct control owns the accommodation. We will ensure the accommodation is clean and tidy and in a condition to fulfill our obligation. If you find any maintenance or housekeeping problems upon your arrival, please telephone our office as soon as possible at 941-474-9536. Manasota Key Realty, Inc. is not responsible for activities adjoining or within the immediate area of the accommodation such as maintenance or construction on adjoining properties or land, beach erosion or public access to Manasota Key. Manasota Key Realty, Inc. will not be responsible for notifying you should any of the above occur. However, we will do our best to keep you informed if possible.

 

Office Hours and Contact Telephone Numbers:

Normal office hours are Monday to Friday 9:00am to 4:00pm. The office telephone number is 941-474-9536. If the office is closed, there will an answering service with a live person to take a message at this telephone number. The on-call personnel provide assistance for emergencies pertaining to your accommodation. However, any medical or fire issues, please call 911 immediately.

 

Arrival and Departure Process:

The accommodation will be available for occupancy at 4:00pm on the date of arrival. The property key and any other appropriate information will be placed in a lockbox outside our office doors (1927 Beach Road). Your reservation must be paid for in full and all required paperwork signed and returned to our office (including but not limited to the Guest Registration, Credit Card Slips, Condominium Application, Boat Slip Request, Terms & Conditions, Rules & Regulations Documents, etc) prior to your arrival and keys released and/or the combination to the lockbox provided.

 

Check out time is strictly at 10:00am on the date of departure. The property key(s), garage remote, boat trailer tags, etc. are to be returned to the office on your date of departure. Please put all items through the mail slot on the main office door located at 1927 Beach Road. Keys are NOT to be returned to the lockbox. Failure to do so will result in a $25 charge on the security deposit. The accommodation is to be left in neat and tidy condition. Please leave any used beds unmade and used towels on a bathroom floor. Please be courteous of the next guest and make sure that if you’ve used the BBQ grill, to leave it clean.

 

Trash bags/receptacles should be taken to the street/dumpster on the appropriate day(s) for pick up. Trash in Charlotte County goes out on Monday night and is picked up Tuesday. Trash in Sarasota County goes out Thursday night and is picked up Friday. Please bag all trash and if it is trash day make sure it is left curbside in the trash container for pickup. Recycling is to be put into the container loose (do not bag recycling). Excess trash left upon your departure will result in a $5 a bag charge and taken from your security deposit. A $50 fee will be assessed if the trash is not put out on the appropriate evening and can(s) returned to the proper location after trash has been picked up.

 

Your Responsibility When at the Accommodation:

Air conditioning- Do not set the air conditioning lower than 73 degrees. Keep all doors and windows closed when the air conditioner is in use. Failure to do this could result in higher than normal utilities and will be deducted from your security deposit.

 

If You Wish to Complain:

If you have a problem during your stay, you MUST inform Conch Out Vacations at Manasota Key Realty, Inc. as soon as possible during normal working hours (unless it is an emergency in which case it must be reported immediately) who will endeavor to correct the matter. If the problem cannot be completely resolved at the time, the complaint must be made in writing within 14 days of your arrival to the accommodation. Reference to your property and all relevant information is required. It is therefore a condition of this contract that you communicate any problem as soon as possible while in the accommodation. If you fail to do this, we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the problem.
